s there is no appeal. H. Modification Procedures 1. Modifications Equal to or Less than 10% a. A project approved pursuant to this Section (Expanded Administrative Review) may seek a modification to modify conditions of approval for the original action prior to the issuance of the certificate of Occupancy . b. For purposes of this Section (Expanded Administrative Review), a “modification” means any changes in the proposed physical development or related conditions of approval that were approved in the original action by no more than 10 percent. c. A modification does not include the granting of any new rights or increased or additional incentives, nor does it include the granting of any new deviation from zoning regulations in this chapter or Chapter I.
